Terms of Service

1. Acceptance of Terms

By accessing or using KitchenSorted ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. KitchenSorted is operated from New Zealand and is intended for New Zealand food businesses.

2. Description of Service

KitchenSorted is a record-keeping platform that helps food businesses keep the records their Food Control Plan or National Programme requires — including temperature logs, cleaning records, receiving logs, corrective actions and staff training records — and generate a verification pack to share with a verifier. It is a tool to help you keep and organise your records; it is not a Food Control Plan, food safety advice, or a guarantee of any regulatory outcome (see clause 7).

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You must be at least 16 years old to create an account.

4. Plans, Payment and Renewal

  • Free plan. The free plan is free to use for one site, with the limits described on our pricing page. No credit card is required and there is no trial period — the free plan is not time-limited.
  • Paid plans. Paid plans (currently the Verification-ready annual plan and Multi-site plan) are billed annually in advance in New Zealand dollars. The one-off verification pack is a single charge, not a subscription. Current prices are on our pricing page and may change with at least 30 days' notice; changes do not affect a period you have already paid for.
  • Renewal. Annual plans renew automatically each year unless you cancel before the renewal date. We will email you before your plan renews. You can cancel at any time from within the app.
  • Payment. Payments are processed securely by Stripe. We do not store your full card details.

5. Refunds and money-back guarantee

  • New annual subscriptions come with a 30-day money-back guarantee: if you cancel within 30 days of your first annual payment, we will refund that payment in full.
  • One-off verification pack credit: if you purchase a one-off verification pack and upgrade to an annual plan within 60 days of that purchase, we will credit the pack price against your first annual payment. Contact us at [email protected] (or reply to your pack receipt) and we will apply it.
  • After the first 30 days, if you cancel a paid annual plan it continues until the end of the period you have paid for and then stops. We do not provide pro-rata refunds for the unused part of a paid year, except where a refund is required under the Consumer Guarantees Act 1993.
  • The one-off verification pack is a digital product delivered immediately. Once a pack has been generated and made available for download it is non-refundable, except where a refund is required by law.
  • Nothing in this clause limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded.

6. Your Data

  • You retain ownership of all records and data you enter into the platform.
  • We will not access your data except as necessary to provide the Service, resolve support issues (with your consent), or comply with legal obligations.
  • On paid plans you can generate and download PDF and Excel reports and verification packs of your records. You can also request a full copy of your account data at any time by contacting us.
  • You are responsible for keeping your own records for as long as the law requires (New Zealand food law generally requires food safety records to be kept for at least four years). Paid plans retain your records for at least four years; the free plan keeps a limited visible history as described on the pricing page.
  • You can delete your account from within the app or by contacting us. After deletion your data is retained for a short grace period and then permanently deleted, unless we are required to retain it by law.

7. No Compliance Guarantee

KitchenSorted helps you record and organise your food safety information. It does not make your business compliant, is not a substitute for your Food Control Plan or National Programme, and is not professional food safety advice. Using KitchenSorted does not guarantee that you will pass a verification or meet any legal requirement. You remain solely responsible for operating your business safely and for meeting all obligations under the Food Act 2014, the Food Regulations 2015, your Food Control Plan or National Programme, and any other applicable law. You are responsible for the accuracy of the records you enter.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorised access to the Service or its systems.
  • Reverse engineer, decompile, or disassemble the Service.
  • Share your account credentials with unauthorised individuals.
  • Use the Service in a way that could damage, disable, or impair its functioning.

9. Limitation of Liability

To the maximum extent permitted by law, KitchenSorted shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, business interruption, or regulatory penalties.

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Where you acquire the Service for the purposes of a business, to the extent permitted by law the guarantees in the Consumer Guarantees Act 1993 do not apply.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Termination

We may suspend or terminate your account if you materially breach these Terms. You may terminate your account at any time by cancelling your subscription and deleting your account.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or the Service are subject to the exclusive jurisdiction of the New Zealand courts.
